Question: Abc journalists recognised for their legal reporting
While our journalists are committed to protecting the integrity of their profession, we are also conscious that those journalists who do so may face legal consequences for doing so. They will face prosecution for defaming a public figure.
A court would also consider any potential criminal convictions for defaming a public figure through the dissemination of false information or for failing to report the material as necessary. The courts are also prepared to sanction an individual for "serious professional misconduct", depending on the severity of the case. A journalist may face up to three years in prison.
However, there are exceptional circumstances where a journalist may face a lesser criminal sanction – for example if they have committed a serious criminal offence and cannot demonstrate that any benefit to the public or any other lawful purpose outweighed the harm resulting.
For example, in most circumstances we consider that a breach of the Official Secrets Act 2003 (OSA 2003) would be appropriate, in particular where:
the journalist or news editor intended to damage the reputations of the political party or organisations they were reporting on;
the journalist or news editor acted in the course of their professional activity; and
the person being contacted was acting for or on behalf of a political organisation, as determined by the police.
A journalist who was the subject of a legal action over a complaint that the journalist failed to protect their sources should be accorded the same level of legal protection as those who had been accused of this conduct.
It would be the duty of the journalist or news editor to ensure that all parties involved in the investigation were informed immediately of the circumstances surrounding a breach of the Official Secrets Act 2003.
Should a media outlet or party to a campaign or political campaign take action to correct a breach of the Official Secrets Act 2003, or other related legislation, it is the responsibility of the journalist or news editor to report this case to the police.
If the matter continues to progress it will be the responsibility of the journalist or news editor to make a submission to the IPCC regarding their efforts to protect sources.
Where a news reporter or journalist from a particular outlet has been suspended or disciplined, or both, there will be no recourse to the courts or other legal remedies. However, the law applies, including to media organisations that have engaged in "cyber-harassment" or otherwise engaged in abuse of personal information in the publication of such information.
This includes the case where any personal information (such as a member's name, email address, or telephone number) or sensitive data in such cases has been compromised.
